Terms of Service
These Terms of Service govern your use of the ModernOps website. By using this site, you agree to these terms. Services delivered under a signed agreement are governed by that agreement, which controls over these terms.
01Acceptance of terms
By accessing or using this website, you agree to be bound by these Terms of Service and by our Privacy Policy. If you disagree with these terms, please refrain from using the site. We may update these terms as described below, and your continued use means you accept the changes.
02Informational purpose only
The content on this site is provided for general informational purposes. We work to keep it accurate, but we make no warranty that it is complete, current or error-free. The site offers no professional, legal, financial or engineering advice for your specific environment, and decisions about your infrastructure should rest on an assessment of your particular situation rather than on general website content.
03Intellectual property
The content on this site, including text, graphics, layout and the ModernOps name and logo, is owned by ModernOps or its licensors and is protected by intellectual property laws. Vendor names, product names and logos referenced on this site are trademarks of their respective owners and are used for identification only, and their use implies no endorsement. Copying, reproducing or reusing our content requires our written permission, except where permitted by law.
04Acceptable use
You agree to use this site only for lawful purposes. The following are prohibited:
- scraping, harvesting or collecting content from the site for resale or redistribution;
- attempting to gain unauthorized access to the site or its systems, or interfering with its normal operation through attacks, malware or excessive automated requests;
- using the site in any way that violates applicable law or the rights of others.
05Client engagements
Any services ModernOps provides to you are governed by separately executed agreements and statements of work. Those documents define the scope, service levels, pricing and obligations of each engagement, and they control over these terms in the event of any conflict. This website and its content create no contract for services and no client relationship.
06Third-party links
This site may link to third-party websites for convenience. Those sites are outside our control, and we accept no responsibility for their content, policies or practices. A link implies no endorsement, and your use of a third-party site is at your own risk and subject to that site's terms.
07Disclaimer of warranties
This site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, ModernOps disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and makes no warranty that the site will be uninterrupted, secure or error-free.
08Limitation of liability
To the fullest extent permitted by law, ModernOps and its officers, employees and agents will have no liability for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or business, arising out of or related to your use of this site, whether based in contract, tort or otherwise, even if advised of the possibility of such damages.
09Indemnification
You agree to indemnify and hold harmless ModernOps and its officers, employees and agents from any claims, losses, liabilities and expenses, including reasonable legal fees, arising out of your use of the site or your violation of these terms.
10Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute relating to these terms or the site will be subject to the exclusive jurisdiction of the state and federal courts located in Pennsylvania.
11Changes to these terms
We may revise these terms from time to time. When we do, we will update the effective date at the top of this page. Material changes take effect when posted, and your continued use of the site after that means you accept the revised terms.
